1. License to Use

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the application on your personal device for non-commercial purposes, subject to these Terms. Copying, modifying, distributing, selling, sublicensing, or reverse engineering the application or any part of it is strictly prohibited.

2. Description of Service

BG Eraser is a photo editing application that allows users to remove backgrounds from images using artificial intelligence running directly on the device. The application also offers manual editing tools, cropping, and export options. All processing is performed locally on the user's device.

3. User Content

You retain full ownership of all images and content you create, edit, or process with the application. We claim no rights over your content. Since all processing occurs on your device, your content is never uploaded to our servers or any third-party services.

• You are solely responsible for the content you edit and share through the application.
• You agree not to use the application to process or distribute illegal, infringing, defamatory, or third-party rights-violating content.

4. Intellectual Property

The application, including its design, code, artificial intelligence model, graphics, icons, and overall appearance, is the intellectual property of Robles Code and is protected by applicable copyright and intellectual property laws. The U2NetP model used in the application is used under its respective open-source license.

5. Acceptable Use

You agree to use the application only for lawful purposes. The following is expressly prohibited:

• Using the application to create, edit, or distribute illegal, harmful, or offensive content.
• Using the application to infringe intellectual property rights, privacy, or other third-party rights.
• Reverse engineering, decompiling, or disassembling the application or attempting to extract its source code.
• Modifying, adapting, or creating derivative works based on the application.
• Using the application for commercial purposes without prior written consent.
• Attempting to circumvent, disable, or interfere with the application's security features.

6. Disclaimer of Warranties

The application is provided 'as is' and 'as available', without warranties of any kind, either express or implied. We do not warrant that:

• The application will meet your specific requirements or expectations.
• The application will operate uninterrupted, securely, or free of errors.
• The results obtained, including AI-generated background removal, will be accurate, complete, or satisfactory for any particular purpose.
• The application will be compatible with all devices or operating system versions.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Robles Code shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or business interruption, arising from the use or inability to use the application. Robles Code's total liability for any claim related to the use of the application shall not exceed the amount you paid for it, if any.

8. AI-Generated Results

The background removal feature uses artificial intelligence, whose results may not always be perfect. Model accuracy depends on factors such as image quality, subject complexity, and lighting conditions. We do not guarantee the accuracy or quality of AI-generated results. Manual editing tools are provided to refine the output.

9. Device Requirements

The application requires a compatible device with sufficient processing power and storage to run the AI model on-device. Performance may vary depending on hardware specifications. We are not responsible for performance issues resulting from insufficient device capabilities.

10. Updates

We may periodically release application updates that include bug fixes, new features, or improvements. While we are not obligated to provide updates, we recommend keeping the application up to date. Continued use of the application after an update constitutes acceptance of the modified Terms.

11. Termination

You may stop using the application and uninstall it at any time. We reserve the right to discontinue the application or restrict access to it at any time and without prior notice. Upon termination, all rights granted under these Terms will immediately cease.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Mexico. Any dispute arising from these Terms or the use of the application shall be subject to the exclusive jurisdiction of the courts located in Mexico.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Robles Code regarding the use of the application and supersede any prior agreements or understandings.

15. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will update the 'Last Updated' date at the top of this page. Continued use of the application after any changes constitutes acceptance of the modified Terms.
